i got whacked!
Well group I got nailed on Sunday afternoon. Coming down the backside
of Mt. Lemmon here in Tucson I was about a mile from pavement when I
crested a rise in the road and there was a Ford F150 coming the other
way .. and then it left-turned right in front of me and stopped ..
leaving me no where to go.
I slid the bike 120' so says the sheriff and used both brakes .. figure
my speed was 40/45 mph ... I then laid the bike down to get it between
me and the truck .. that didn't work as the bike spun one way and I
went under the truck. Hit my back going under the truck and was
knocked out.
I was air lifted to the local hospital in Tucson and after an afternoon
of x-rays, cat scans, and numerous other tests I was released. I am
basically beat up pretty good .. a bit of road rash but not bad as my
full face helmet and leather 3/4 length did their jobs well.
I went to work yesterday and am doing o.k. Got good drugs and they are
doing well on the pain. I saw the bike yesterday and the Happy Trails
racks and pelican cases saved my butt .. literally! The racks were
strong enough to bend the frame of the F650 and the Pelican case was
bent and scarred but not broken! I'll be ordering a new set of both
methinks ... sturdy stuff. The bike has a bunch of damage to it but
I'll let the BMW shop take care of that.
A question I have of those who have had accidents like this in the past
... how do you proceed? Who takes care of what? The party has
insurance and by the sheriffs say so they were ticketed and are at
fault. I figure the bike will be taken care of and the other stuff ..
helmet, jacket, etc. but what about medical bills and do I ask for
any compensation for my pain .. I am going to work but it's slow going.
Id rather be working then sitting at home .. figured I'd just stiffen
up like a board by not moving around.
Does my insurance agent help with all this?

Don't settle for any offers from the other guy's insurance company. Get yourself a good lawyer!
Any quick settlement may look good right now, but you may regret it in the long term.

i got whacked!
Al, hold off on a lawyer for a minute. Whose fault it is has already
been established, so it is up the his insurance company to offer a
settlement. Pain and suffering don't mean a thing. The lawyer is
going to get a third no matter what. Of course they will lo-ball, so
you are still having headaches that come and go and your back isn't
quite right. Complain. In other words you are not dying nor are you
going dancing. What you really want is to get the bike fixed and your
gear replaced. They are not going to give you a free trip to Cancun for
R & R. If all else fails get a legal help, maybe he'll get the trip to
Mexico. Remember the insurance company has to settle.

i got whacked!
Most likely best to use a lawyer; insurance co.s will just
procrastinate usually.
1)get a friend/relative lawyer to send letters if you know one ie
might save 40%
2)get yourself to an orthopedic md--chiroquacks don't have the same
prestige in court/injury related issues
3)they owe you a rental bike till yours is fixed
4)your own insurance might cover expenses and then go after other
insurance co for you.

Glad to see that you up and about. I would think about seeing a lawyer; let
him/her take care of settlement while you take care of healing.

Congratulations on your survival. I'm glad we didn't lose another one. I
recently had a banger with my cage-guy in front of me came over the median
and hit me-head on in my Accord(totaled). Here's what I was told; contact
YOUR agent. You can send the medical bills to your insurance and let them
go after the other guy's insaurance, or you can get a lawyer. I was tole not
to sign anything. My suggestion; see a doctor and let him know all your
pain. You have to establish your condition. 2, don't settle for awhile. I
had no problems for 2 months then started having neck and back pain-The
Chiropractor has been treating me for 4 weeks now. I've lost a lot of work
time due to the pain and lots of Chiropractic time. Good luck. BTW-I've not
needed my helmet or cycle jacket but its stories like yours that make me
glad I'm a believer.
