I just hit an all time high -- $78.89 per mile! Here's the story: Was returning from a little solo camping trip in northcentral PA, up towards the NY border. I was a little disapointed in the lack of "drivable trails" that far north. (In PA, we get our rocks & ruts fix on these jeep trails that the State kindly leaves open for us.) Anyway, I found a promising looking road on some state game lands near Clearfield, PA. When I got there, it had a locked gate, with a side opening for snowmobiles. Of course the grass is always greener (and the rocks bigger) on the other side of the gate, so I slipped past the gate onto a great trail. Well, as I crested the top of a hill, I noticed a DCNR (Dept of Conservation & Nat. Resources) truck at the bottom of the hill, with nobody around. If I had been reasonably intelligent, I would have turned around and gotten out of there, but no! I slowly went down the hill to the truck. Then, I noticed two guys lying on a steel grate bridge painting. They had painted the entire width of the bridge behind them, about a third of the way accross. I looked at them, they looked at me, nodded my head, turned around and went back the way I came. I thought nothing more of it until I got a phone call from a Fish & Wildlife officer citing me for my activities. Seems the painters got my plate #, and turned me in. Fined $100 plus $42 costs. $78.89 a mile. Next time, I won't be so stupid, that's for sure. But now to my question -- I was wondering how big the fines are in other states for riding "out of bounds?" Is Pennsylvania expensive? Jay in PA A15 $142 poorer

You weren't even present to sign the damn citation! "Heresay, your honor. I move to dismiss." Too bad it'd cost more to fight it than it would to just pay it. Can you enter a plea by mail?

Never been caught out of bounds here in SoCal, but I always try to splash some mud on my license plate when I'm out and about just in case. __Arden

Ya Jay, I don't think they can make it stick. I'd fight it; I think it will only cost $6.00 more. They have to be able to ID you and the bike. Plus there's a chance that they'll be no shows. They're just a fishing expedition into your wallet to scare you. My state trooper friend told me to always take it to court. Mark

I just thought about this a little more, and I have a suspicion that the citation will never show up in the mail, because it doesn't exist. The officer was trying to put the fear of God into our fearless wanderer. I think he succeeded. RM

Got the citation already. It says if I don't respond, they'll issue a warrant for my arrest. I can plead not guilty by mail, buy I still have to send in the full fine, and then try to get it back. I'd have to drive to Clearfield, lie to the District Justice, and hope that the TWO guys who saw me, a 6'6" guy on a large green & silver "dirt bike" with my license plate on the back, don't show up. I feel very confident! Jay

The HT PL rack is very helpful in this regard if your plate has been relocated upward on the inner fender: the crossbar cuts right across the middle of the plate, making the number even harder to read. I hated to lose the inner fender and give up this aid to anonymity. BTW, I hear the fine for going off the reservation on Forest Service land is $1000.00.

No need to lie. You don't have to say a word. They have the burden of proving, beyond a reasonable doubt, (if it's a criminal citation) that you were the perpetrator. Whoever was riding your bike was wearing full riding gear, or at least a helmet with a chin bar, wasn't he (or she)? Use cross examination to point out their inability to make a positive ID. Don't testify at all. When the state rests, you rest too, and move to dismiss.

Actually, your case is even better than that, unless it's obvious how you got onto posted land: "when did you first the motorcyclist?" "So you didn't see how he or she rode into the area where you first saw him or her?" "So you have no idea whether the land was posted where the motorcyclist entered it, do you?" "In other words, you have no idea whether his or her presence there was intentional, do you?" If intent is an element of the violation, it too has to be proven by the state; you have no obligation to offer testimony to disprove it.

I did that once. I got a speeding ticket for passing a police car. I had my speedometer checked out and it read 20k too high. Because court was so far away, I wrote a letter to the court asking to plead innocent, and sent the speedometer readings with the letter. The judge was nice enough to let me off after he read the letter.
