Dear Whitworth Heads: From time to time there have been statements and comments made by members of the list which were critical of suppliers, vendors and restorers. I wish to draw your attention to an article on page 62 of the September 2001 issue of Car Collector magazine. According to the article, a dissatisfied customer made derogatory statements about a restorer that he used and found himself facing a jury which awarded the restorer $400,000 for "business interference" and $2,500,000 for slander. Apparently the case will be appealed, but the message is noteworthy. The article also discusses the perils of making true statements that are critical. It is well worth reading and we have found Car Collector magazine an excellent source of information. Dennis Adler, is well respected and does a wonderful job in his publication. If he was sued for slander, which means "FALSE" statements, then that might be believable. However, no one would ever lose a lawsuit if he could back up his claims......so don't worry about getting sued for raking a dishonest vendor over the coals......as long as you can prove what you're claiming. There are ways to make a statement without slander. You can simply sa y "I was not happy with the results'. PTH

I guess thats why I try to do all my own work. First, I know whats under that shined up paint; And its it not right, I look no further than the shaving mirror. Otherwise, it can become hobby-defeatingly expensive. Mark TC8126 EXU

Hey now. My 'other' car is a BMW, and I live in Birmingham where the said d-head doctor lives. The award was not 2.5, it was 4 mil. Later reduced to about 60K. The 'good doctor' had not even noticed the paint difference. His detailer found the overspray on a supposedly "new BMW'. I doubt the paint repair reduced the car value much. but a later buyer might suspect a disguised wreck and so to 'punish' the dealer, for hiding the repair they fine was imposed. The dealer should have pointed out that the paint had been damaged and repaired prior to original sale. the doctor probably would not have cared at that point, or may have accepted a 2-4 thousand reduction in price. As I recall the lawyer for 1/2 of the award anyway. When you can get that kind of money, why not try? Much like the often referenced McDonalds spilled coffee for 4 million. Any dummy should know the coffee is hot, and not place it between her legs. I don't see the burn worth 4 mil either. Americans sue on any pretext, regardless of reason. Why not, if you can collect/. Just remember to split 50% with your attorney. PTH
